Terms & Conditions

1. GENERAL


(A) In these Terms & Conditions of Sale, "the Company" shall mean HSC Machinery Spares and Consumables and "the Customer" shall mean any, person, firm
Company, Public Authority of Statutory Body who orders equipment, products or service from the Company.
(B) In accepting any order of making any supply, the Company's Condition of Sale applies, notwithstanding any contrary condition which
may be stated in the Customers Condition of Purchase.
(C) No exception or amendment may be made to these Terms and Conditions of Sales unless confirmed in writing on behalf of the Company by
a Director, the Secretary, or other duly Authorized person,
(D) The placing of an order with the Company shall be deemed to be an acceptance of these Terms and Conditions by the Customer.


2. QUOTATIONS


(A) All quotations are made on the basis of prices ruling at the time of quotation but are subject to alteration without notice.
(B) Unless otherwise stated quotations are held for 28 days.


3. PRICES


(A) The prices quoted in Company's catalogues and price lists are correct at the time of publication, but are subject to alteration without notice.
(B) All prices quoted are ex-works, and plus carriage direct to the customer.
(C) Whilst every care is taken in the preparation of price list quotations, the Company cannot take the responsibility for any accidental errors and/or omissions.


4. DELIVERY


(A) The place of delivery shall be deemed to be the Customer's premises.
(B) All delivery dates are estimated only, as next working day and the Company cannot accept liability for any loss, damage or injury arising in whole or in part from any delay or failure to deliver by a particular date.


5. DAMAGE OR LOSS IN TRANSIT


(A) The risk in the goods passes to the Customer upon dispatch from the Company's premises. Any damage or loss in transit must be notified to the Company and the Carrier within THREE working days of notification of dispatch of goods. Failure to do so will result in whole or in part from any delay or failure to deliver by a particular date.


6. RETURNS


(A) No returns will be accepted unless authorized by the Company in writing.
(B) Goods so returned must be consigned carriage paid and be accompanied by a packing note quoting the Company's Delivery Note or Invoice
Number. Any goods supplied to a special order at the customer's request cannot be returned under any circumstances.
(C) Any goods returned may be subject to a handling charge of no less than 25% at the Company's discretion.


7. CANCELLATION


(A) Under the Consumer Contracts Regulations your right to cancel an order starts the moment you place your order and doesn't end until 14 days from the day you receive your goods.

8. WARRANTY


(A) The Company will make good by repair, or at the Company's option, by the supply of a replacement. Defects which, under proper storage and use, appear in the goods within six months of delivery and arise from faulty design (other than a design made or furnished by the Customer). materials or workshop.
(B) The warranty given in this clause is subject to the following provisos, namely
(i) That the Customer shall have followed all instructions issued by the Company, (verbal or written) in relation to the goods.
(ii) That in case of defects which would have been reasonably apparent to the Customer on reasonable examination of the goods on delivery, the Customer shall notify the Company of the defects, in writing, within 14 working days of delivery.
(iii) That in the case of any defects, the Customer shall notify the Company of the defects in writing within 7 working days of the date when the defect becomes apparent.
(iv) any goods ordered by the Customer, and kept for more than 14 working days and deemed to be the customer's satisfaction and
cannot be returned under any circumstances.


9. VALUE ADDED TAX


(A) Where applicable Value Added Tax will be charged at the rate ruling at the time of dispatch.


10. PAYMENT


(A) All accounts are due and payable at the end of the month following delivery of the goods.
(B) In the event non-payment, the Company reserves the right to withhold further deliveries of goods until such time that all outstanding amounts due are paid.


11. LIEN


(A) It is expressly stated that the title in any goods supplied by the Company does not pass to the Customer until payment in full has been received by the Company in respect of any such goods and any other amounts due and payable to the Company.


12. FORCE MAJEURE


(A) The Company shall not in any circumstances be liable for it's failure to perform any contract if such failure arises either wholly or in part from one of the following: Act of God, War, Civil Commotions, Strike, Lock-Out, Fire, Flood, Parliamentary Statute or any other rule, order or requisition issued by Government Dept, or any other causes whether or not of a like beyond the Company's control.


13. HEALTH AND SAFETY AT WORK ACT


(A) All goods are sold on the express understanding
